福建省集体林林权流转方式探讨

Disscussing the Circlulation Means of the Collectivity Forest Property Right in Fujian

在产权明晰的前提下,林权流转是实现森林资源资产与市场要素有机结合,促进林业规模经营的重要手段。目前我国对林权流转的规定较少,实践中也存在不少问题。在分析福建省集体林林权流转方式的基础上,提出在入股方式中应当坚持入股自愿、明确林业股份合作组织性质;在转让方式中应当明确转让方和受让方资格及确定发包方同意权的性质等问题,并就继承和抵押是否属于林权流转方式提出见解。

On the basis of definiting forest rights, the Forest Property circlulation is the important means to collect forest resource assets with market, meanwhile it can improve large-scale management. At present, there is little regulations of the Forest Property circlulation and a lot of problems in practice. This paper analyzes the circlulation means of the collectivity forest property right, according to the research of the collectivity forest property reform in FuJian province. Then focuses on the study of the legal problem about the special means, such as transfer and buying share. At last analyzes mortgage and Inheritance, and put forwards the view that mortgage isn＇t the means of the forest property circlulation.
