摘要
土地承包经营权合同是一种民事合同,由此产生的土地承包经营权是一种物权与债权相混合的民事权利,由内部土地承包经营合同和外部土地承包经营合同派生出来的土地承包经营权在性质上表现出向物权和债权倾斜的现象。
The contracted land management contract is a kind of civil contract, the resulting land contract management rights is a kind of civil rights of mixed property and claims. The land contract operation rights which is derived from the internal and external contracted land management contracts demonstrates the nature of leading to property rights and claims.
