论行政权与村民自治权的冲突及解决

On the Conflict of Executive Power and Villagers Autonomy Rights and the Solution

村民自治制度作为国家促进农村社会经济发展,实现国家现代化的重要举措,在经历的20多年中的确对农村社会的发展发挥了重要的作用,但由于其本身制度设计的根本动机和目的以及在国家现代化的历史长河中国家与农村社会的关系来看,其国家行政权与村民自治权的冲突的发生是不可避免的也是必然要出现的,因此,我们必须认清冲突产生的根源,从而更加实际地去化解这种冲突。文章试图从村民自治的历史发展的背景,从国家推行村民自治制度的实质及我国现代化进程中国家政权在农村基层的作用来分析冲突的表现以及冲突的原因从而找出解决的办法。

To China, villagers autonomy system, as an important measure for accelerating economic development in rural society and achieving the modernization, has played an important role in the development of the rural community for more than 20 years. However, because of the purpose and the fundamental motive of the system＇s design and its relation to the state in the process of modernization, the conflict between the national administrative power and the autonomy of the villagers is not only inevitable but also is bound to arise. Therefore, we must look for the root of the causes and try to solve the confhct in a practical way, This paper, from the background of historical development, from the essence of the implementation of the villagers autonomy system and from the function of state power in the rural areas, tries to analyze the situation and the causes of the conflict and then find a solution to the conflict.
