摘要
华沙公约体系是通过实体规则进行国际法调整的成功典范。1929年《华沙公约》及嗣后历次修订所构成的华沙公约体系试图协调国际航空运输中的各种矛盾冲突问题,建立一个为国际社会所广泛承认的文件体系。华沙公约体系之下的国际航空运输损害赔偿问题涉及到了普通法系国家(尤其是美国)的诉因之争。围绕精神损害赔偿问题和惩罚性赔偿问题,在理论和司法实践中产生了较大分歧,构成华沙公约体系一体化和现代化改革的一条线索。
Warsaw Convention System is a successful model of applying international laws by the adoption of substantial rules. Warsaw Convention System constituted by Warsaw Convention 1929 and its subsequent amendment files endeavors to harmonize the conflicts arising from the international aviation transport and to build up a globally recognized files-system, The compensation under Warsaw Convention System involves the divarication as to the causes of action in Common Law legislation, particularly in USA. The important bifurcation in both theory and judicial practice connected to the mental compensation and punitive compensation becomes a clue of the integration and modernization of the Warsaw Convention.
