建立统一的中国航空法体系——理论初探与立法建议

Establishing a Unified China Aviation Law System-Theoretical Analysis and Legislative Proposals

近年来,中国的民用航空事业取得巨大进步。中国的航空法律制度建设也取得较大成就,相关法律制度日趋完备。然而,中国的航空法律体系仍然存在不少问题,特别是缺乏一部统一的航空法。这种情况制约了中国航空业,特别是通用航空业的发展,进而阻碍了中国相关经济增长点的培养。文章试图通过剖析中国航空法律体系中存在的不适应经济发展的问题,提出建立统一的航空法体系的基本构想和建议。

In recent years, China＇s aviation industry has gained visible progress. Meanwhile, China＇s aviation law system has become more and more complete. However, many problems still exist in this system. There especially is a lack of a unified aviation law, which limits the development of China＇s aviation industry, and general aviation in particular, and hinders the economic growth. This article attempts to put forward some basic concept and proposals for China＇s unified aviation law system through analysis of the existing problems in our current aviation law system.
