信用证是目前国际贸易中一种普遍的支付方式,独立抽象性原则是信用证的基本原则。从商业交易的一般原则来判断,固守独立抽象原则是有悖于诚实信用原则的,因此有必要建立欺诈例外原则。信用证的欺诈例外原则不论是在法理上还是在国际贸易的实践中都是信用证法律制度的一项基本原则。本文主要从信用证欺诈原则的建立,信用证欺诈例外原则的法理分析及信用证欺诈例外原则的适用条件等几方面对信用证欺诈例外原则进行了阐述。

Letter of credit is one of payment manners, which is prevalent used in international trade at present. The principle of independence and abstract is the basic principle of the L/C. Judge from the commonly principle of business, adhesion to the principle of independence and abstract is infraction of the principle of honesty. So it is nee- ded to establish the principle of fraud exception. The principle of fraud exception is one of the basic principles of the L/C, which is not only on jurisprudence but also on the practice of international trade. This thesis will expound the instauration of the principle of fraud exception, the jurisprudence analysis of the principle of fraud exception and the application of the principle of fraud exception.
