论“以人为本”的法治理念与现代法治之“法”

法治理念包括法治所追求的伦理基础和价值理想。法治理念之普遍诉求在于实现约束国家或政府权力,保障人权和公民权利与自由。限制权力和保障权利的精义在于法治之"法"。现代法治之"法"要体现"以人为本"的法治理念。当代中国将"以人为本"的人文主义思想,作为法治理念的普遍诉求,与中国特色及其本土资源形成共鸣并达成共识,是一种最好的表达。

The idea of Rule of Law includes the pursuit of ethic base and value ideas. The requirement of the Rule of Law is to restrict the country and government power, ensure human rights and liberty. The main point to restrict power and ensure rights is the Law and the main point of the Law is the people - oriented idea. The humanist people -oriented idea should be combined with Chinese characteristics and native resources.
