论农民权益的保护——以公益诉讼为视角

Discussing on the Protection of Farmer's Rights and Interests——From the perspective of public interest

目前我国正处于社会转型时期,经济迅速发展推动社会巨大变迁。与此同时,各种侵害农民公共利益的事件屡见报端。为了周全而充分地保护农民合法权益,尤其是使农民的公共利益不致流失,发展和完善农民公益诉讼制度是理论和实务界都必须直面的课题。本文的主旨在于探讨农民公益诉讼的现实障碍,借鉴学界有关公益诉讼的研究成果,谋求完善农民公益诉讼的路径选择。

At present, the society of our country is in her formative years, and the economic flourish might as well contribute greatly to the transformation of society. Meanwhile, various incidents of encroac- hing upon farmer＇ s public interest jump to the headlines. To considerably protect farmer＇ s legal rights and interests, especially to prevent the loss of farmer＇ s public interest, entails the development and perfection of farmer＇ s public interest system both theoretically and practically. Through uncovering the existing obstacles to farmer＇s public interest lawsuit, and by employing the achievements in the field on public interest lawsuit for reference, this paper attempts to explore approaches to perfect the way to selection of farmer＇s public interest lawsuit.
