论知情权的宪法保障——厦门“PX项目”风波的启示

On Constitutional Guarantee on Informed Right:The Inspiration of PX Program in Xiamen

随着社会的进步,信息的作用越来越重要,信息资源的拥有已成为人们生存和发展的首要条件。我国公民的知情权意识开始被唤醒。通过分析知情权的宪法理论基础以及该权利在其他国家的发展历程和法律保障实践,结合我国的基本国情、立法进程及知情权的发展现状,提出宪法应对知情权作出明确规定,建立知情权的法律体系,构建公民知情权的保障机制。

With the development of society, information has played a more and more important role in society, which has become the utmost element for existence. In China, citizens' consciousness of having informed right has been aroused. Based on the analysis of constitutional theories on informed right, its development process in other countries, and the practice of legal guarantee, this paper maintains that Constitution should clearly stipulate informed right, establish the legal system of informed right, and construct guarantee mechanism combining with Chinese national state, legislative process and development situation of informed right.
