关于法的目的的争论由来已久,学者们在不同的立场上形成了不同的观点和学说,文章试从工具理性和价值理性的双重视角对法的目的进行解析。法律的目的既在于人类共有价值的追求,最大公益的实现,同时本身的逻辑自洽性又是科学思维的运用,是一种理性的自觉,从而得出法律所应有的理性特征。

The argument about the purpose of law has a long time, and there are different viewpoints and theories in different positions. This paper tries to analyze the purpose of law from the corner of tool reason and value reason, the purpose of law is not only the pursuit of human＇s total value, the realization of the greatest public interests, but the self-consistent logic of law is also the application of scientific thinking and a rational consciousness, so as to get the due rational feature of law.
