论我国中央与地方立法权配置存在的缺陷及完善对策

On the Defects and Countermeasures of China's Central and Local Legislative Allocation

20多年来,我国由中央统一立法的格局逐渐向地方立法分权的格局转变,这对调动地方立法的积极性和填补中央立法的空白起到了积极的作用,但同时也出现立法冲突、重复立法、越权立法和立法权被异化等现象。本文旨在通过对我国中央与地方立法权配置存在的缺陷进行分析,为我国新形势下中央与地方立法权的合理配置理出思路,提出对策,以优化中央与地方立法职能,构建科学合理的、富有生机活力的中央与地方关系。

For the last two decades, the pattern of central unified legislation has gradually transformed into the pattern of decentralization of local legislation, which has aroused the enthusiasm of local legislation and has filled up the vacancy of central-unified legislation. But meanwhile, some phenomenon can be seen as legislation conflict, repetition legislation, exceeding authority to legislate and alienation of legislation. This paper aims at the defects of China＇s central and local legislative power configuration, so we will get the idea of the reasonable configuration and we can propose tral and local legislative functions and build reasonable measures for that, and also we can optimize the cen- and vital relationship between central and local governments.
