The Constitutionalism Thinking on the Peasants' Right Protection

"三农"问题的核心是农民权利问题,农民权利问题是一个人权问题,人权问题是一个宪政建设问题。保护农民权利应从宪政的理论框架和制度安排下寻求方案,这就是以宪政的力量抹去错误的农民身份特征,还农民身份以公民身份,切实有效地参与到国家各项政治、经济、社会文化生活中去,成为既当家又做主的共和国人民。

The core of ＂the three dimensional rural issues＂ is the problem of the peasants＇ right protection. This problem is a problem of human right, and the human right is a problem of constitutionalism construction. To protect the peasants＂ right should seek after the solutions under the theoretical frame and institutional arrangement of constitutionalism. The solutions were to erase the wrong identity character of peasants by the strength of constitutionalism, give back the citizenship to peasants, and participate in the all kind of political, economical and social cultural life effectively to become people of People＇s Republic of China in which peasants were master.
