行政法基本原则司法适用的发展——以正当程序原则在我国的发展为例

The Development on Basic Principle in Administrative Law in Application Justice

通过对最高人民法院公报中的一系列案例进行分析,我们会发现正当程序原则正在从"开放式的原则"流转为"法条式的原则",而造成这一流转的两个重要因素分别是"类推适用"和"典型案例"。正当程序原则司法适用在我国发展的成功为行政法基本原则的司法适用提供了很好的经验。要克服目前我国法院对行政法基本原则适用中存在的不足,就必须客观认识并充分发挥"类推适用"与"典型案例"的作用,从而促进行政法基本原则司法适用的发展。

according to the analysis of the cases in the Communique of the People＇s Supreme Court, we will find that due process is transferring from ＂opening principle＂ to ＇law principle＂, Two important factors which work are ＂Analogy applies＂ and ＂typical case＂. Due process＇s success in application justice has supply good experience for the basic principle＇s application justice. If we want to overcome the deficiencies of the legal principle＇s application, it is necessary to objectively understand and give fuli play to ＂Analogy applies＂ and ＂typical case＂. So as to promote the development of application of the fundamental principles of administrative law .
