行政强制之所以存在设定权"乱"、执行权"滥"的问题,根源在于对行政强制所追求的价值目标理解出现偏差。有必要通过对行政强制行使的过程价值与结果价值的挖掘,构建行政强制权的三重价值体系。并通过比例原则的适用,实现行政强制行使的目标。

There are two problems about the confusion of setting power and the abuse of executive power in the area of administrative compulsory.The source is the deviation of understanding the goal of value in administrative compulsory.So,it is necessary to find out the value of the procedure and the value of the consequence,and then build up the system of value in three respects in the administrative compulsory.By applying the principle of proportionality,we can achieve the goal of exercising the administrative compulsory.
