韩国保障措施法律制度的特征及其启示

Characteristics of the Legal System of Safeguard Measures of South Korea and Its Relationships

韩国在20世纪80年代末就制定了有关保障措施的法律、法规,并通过实施保障措施积累了一定的实践经验。韩国的保障措施法律制度对我国有一定的借鉴意义。与我国保障措施法律制度的比较分析,可见韩国保障措施法律制度的特征。中国应该不断完善《保障措施条例》的内容,并将该条例升格为保障措施法,以进一步提高其保障措施的权威性。

South Korea began to constitute laws and regulations of Safeguard Measures as early as late 1980s, and hence accumulated relatively rich experiences through the enforcement of its Safeguard Measures. Thus the system of Safeguard Measures of South Korea is enlightening to China. This article analyzes characteristics of South Korea＇ s Safeguard Measures by comparing it with the Safeguard Measures of China. The conclusion is that we can benefit from the experiences of South Korea to perfect the contents of Regulations of the People＇ s Republic of China on Safeguard Measures, upgrade them to a law, in order to reinforce the authority of Safeguard Measures of China.
