摘要
在商品房预售合同中,预购人虽然与开发商是地位平等的当事人,但由于开发商对交易信息的独占导致预购人欠缺实质的契约自由,致使契约公正难以实现。通过对现行法进行解释、整理以及在未来的立法中创设相关制度,构建预购人利益保护机制。该机制的构建也可以为那些在交易中严重缺乏缔约能力、信息收集力不足的弱势群体提供借鉴性的保护。
In the forward purchasing contract of commercial house, although the purchaser in advance and the developer are the parties with equal status, the developer's monopoly of dealing information results in the purchaser in advance lacking essential freedom of contract, which causes the failure of fairness of contract. The profits protection mechanism of purchaser in advance can be constructed through explaining and sorting out current law and establishing related system in the future legislation , which also can provide protection for reference to those weak groups who seriously lack capacity to contract or are incapable of collecting information in deals.
