摘要
指导性案例的形成,以实践理性为哲学基础,以人类行为的可重复性和相似性为社会基础,以高质量的裁判文书为文本基础,还需经特定机关依相关程序确认。关注如何形成的同时,也不能忽视妨碍指导性案例生成的制度障碍与现实困境。
The formation of guiding cases takes practical theory as its philosophical foundation, the repetitiveness and similarity of human behavior as its social foundation and high-quality trial documents as its text foundation. While focusing on the formation of guiding cases, we shall not neglect the system barriers and actual difficulties for the realization of guiding cases.
