环境法学方法论研究的回顾与反思

Review and Rethinking of the Research on the Methodology of Environmental law

方法论的研究与建构是环境法学理论体系的重要部分。现有的环境法学方法论研究促进了"方法论的自觉",并对环境法学的"知识增量"作出了贡献,但从总体上看,其是一种"观念导向"的研究进路,缺乏理论与现实的互动,在研究前提上也有深入反思的必要。环境法学方法论应面向实践,遵循"问题导向"的研究进路,以解决具体的环境法问题为宗旨。

The research and construction of methodology is an important part in the theory of environmental law. The existing researches have promoted the ＂consciousness of methodology＂ and made some contributions. But these researches follow the path of big conceptions and lack the connection of theory with practice. The methodology of environmental law should face the practice and follow the ＂problem-oriented＂ path in order to solve the concrete problems.
