The enhancement of negotiation resolution mechanism for medical disputes

分析了当前医疗纠纷协商解决机制的优点和缺点,提出现阶段应该鼓励、引导医疗纠纷双方当事人的协商。立法上应进一步明确医疗纠纷协商的范围,行政上应加强对医疗机构医疗纠纷协商解决的监督,司法上应持认可医疗纠纷协议书具有一定法律效力的态度,保险上应对协商解决医患纠纷持更加宽容的态度。

Analysing the advantages and disadvantages of the current medical dispute negotiation resolution, the author points out that the negotiation resolution should be enhanced at present.It is suggested that the scope of the law be clarified and the supervision in administration be strengthened.The judicature should ratify the validity of the medical dispute agreement, and the insurance company should be more understanding to the negotiation method.
