治理商业贿赂是摆在我们面前的一项重大任务,然而目前的讨论过于注重国家的反应,甚至将治理商业贿赂的希望寄托于刑事手段这一最激烈的国家反应方式。博弈论分析揭示了商业贿赂这一"潜规则"的成因以及破解,对于商业贿赂的治理而言,国家反应实为治标的权宜之策,而社会反应才是治本的长久之略。

As a challenging task, the governance of the commercial bribery focuses at present time on the responses of the government, esp. on criminal method, the severest response of the government. From the perspective of Game Theory, the article reveals the cause and countermeasure of the ＂hidden regulation＂. As far as the governance of the commercial bribery is concerned, the response of a government is a makeshift which can only take temporary solution but the reaction of the society is a long term strategy which can effect a permanent cure.
