完善我国行政权力监督体制之探析

Perfection of Domestic Supervisory System of Administrative Power

要确保行政权利依法、公正、高效地行使,就必须对其进行监督和约束。目前,我国虽然已经初步形成了一个相对完整、较为系统、内外结合的行政监督体制,但有时候仍然存在着内部协调机制不完善、监督主体缺乏独立性、监督操作缺乏可行性等缺陷。因此,一方面要通过建立和完善包括执政党、立法机关、司法机关、群众和社会舆论等监督主体在内的外部监督机制,来使之发挥对行政权力的直接监督作用;另一方面也要通过转变政府职能、建立"有限权力政府"和强化行政监察机关的作用,以及建立行政人员的道德约束机制等内部体制的进一步完善来实现,这些乃是对行政权力进行有效监督的关键。

In order to ensure the exercise of administrative power legally, fairly and effectively, it is necessary to make supervision and control. Though a relatively complete, systematic and inside-and-outside administrative supervisory system has been established up to now, there still exist some shortcomings in it, including the incomplete inside coordinating mechanism, the lack of independence for the supervising subject, and the insufficiency of operable supervisory laws. Therefore, we should improve the outside supervisory system where the ruling party, the legislation, jurisdiction, the public and public opinion all play a party, and at the same time improve the inside supervisory mechanism by transforming the function of governments of different levels, limiting their power, strengthening the role of administrative supervisory organs, and establishing a moral restricting mechanism among administrators. Only by doing so can we make effective supervision on administrative power.
