摘要
18世纪初期的英国,政治环境紧张而复杂,统治者不断通过加强法律机器的严酷性来巩固其统治。这一时期通过的一系列严酷法案中,1723年的《布莱克法案》被认为是英国狩猎法体系中最为严酷的一项法案,也是整个"血腥法典"体系中最为臭名昭著的部分。从《布莱克法案》背景来看,它只是一种应急性措施,具有一定的偶然性;就其实际执行效果而言,由于多方面的原因与其预期目的相差甚远;但如果从18世纪宏观社会转变的视角来看,它则体现着一定的历史必然性。
The environment of the early 18th--century Britain was tense and complicated, the rulers consolidated their rule by strengthening the legal machines. Among the laws passed this period, the Black Act of 1723 was considered the most severe one of the English Game Law System and the most notorious one of the Bloody Code. From the background of the history, it was only a contingency measure that reflected certain occasionality. And due to a variety of causes, its execution effect was a far cry from the expectations. However, from the angle of the macro changes of the eighteenth century society, it reflected a certain degree of inevitability. The author of this article tries to find more meanings by analyzing this typical act.
