我国城郊社区集体土地征用制度改革浅议

On the Land-Expropriation-System Reformation of China's Collective Land in Suburban Community

不同地区不同区域征地政策不一致、同一区域不同征地用途政策不一致、不同阶段征地政策不一致、土地级差地租分配不合理等是我国城郊集体土地征用中存在的问题。原因在于土地产权不清晰、土地征用法规不完善、征收补偿费分配不合理、征收行为中权益不对等及部分地方领导发展观与政绩观出现偏差。因此,加强城郊集体土地非农开发和征收政策的宏观调控、完善土地征用制度改革、合理分配级差地租、建立和完善失地农民的就业安置和养老、医疗保障体系是解决"三农"问题,构建和谐社会的重大课题。

The problems in the expropriation of suburban collective land are mainly the following： there are not unitized policies to the land expropriation in different areas, to the usages of different expropriated land in the same area, and to such land in different periods ; besides, the distribution of differential rent is still unreasonable. It is the vague land property right, the imperfect land - expropriation law, the unreasonable distribution of expropriation compension, and the unfair rights＆interests in such expropriation as well as the diviation of the development＆political achievement view of certain local leaders etc. that contribute to the above problems. Consequently, to settle the problems of ＂San nong＂ （ the peasants, countryside, and agriculture）, and to construct a harmonious society means strengthening a macro - control over the non - agriculture exploitation and expropriation of the suburban collective land, perfecting the land - expropriation - system reformation, distributing the differential land rent properly, as well as setting up and perfecting the employment settlement, endowment policy and healthcare guarantee system of the peasants whose lands have been expropriated.
