On the International Law Nature of the International Private Law——a summary of the past discussion and some new criticism

国际私法的性质问题,尤其是其属于国际法还是国内法,在国内外长久以来持续成为各学者论争的焦点,引发了深刻广泛的讨论。毋庸置疑,这个问题有着重要的理论和实践价值。本文建立在对传统学说的梳理基础上,分析了传统学说论争中的两个概念上的误区,并提出自己的观点,由国际私法调整对象的性质入手,证明了国际私法的国际法性质。

Since long ago scholars have engaged in the debate over the nature of the intemational private law, especially about whether it belongs to the international law or national law. Without doubt, this problem is both theoretically and practically of great significance.With a summary of the previous discussion in which I will suggest two misconceptions, this essay starts with the adjustment object of the international private law and proposes that the International private law is in nature an international law.
