摘要
近20年来,我国的法治进程不断推进,但是冷静观察会发现,法治并没有真正走进生活,变成生活事实。造成法治"表层化"的一个重要原因就是法治文化根基的缺失,特别是私法文化的缺失。历史表明,私法文化精神构成了法治秩序的内在动力和支撑,因此,必须积极培育私法文化,才能有效推进中国法治进程,使法治秩序变成生活现实。
In the recent 20 years, although the progress of law is evident, the rule of law is not in social life as a part. The primary reason for rule of law only in facet is the inadequacy of legal culture, especially private legal culture. The history shows the spirit of private legal culture is the inner dynamic support for order of law. Therefore, it is necessary to develop private legal culture to turn order of law into reality, and push the process of rule of law in China.
