法律意识形态的概念分析

作为一个不容忽视又常被忽视的学术概念,法律意识形态在法理学与法社会学研究中极具有现实性、前瞻性、分析力与解释力。从间接与宏观的意义上来说,法律意识形态是意识形态总体中的一个具体形式与类型;从直接与微观的意义上来说,法律意识形态处于法律意识的整体结构之中。相较于认识论角度,社会学角度是法律意识形态研究的一个突破口,正是这一角度使法律意识形态得以成为一个有前景的学术概念。基于意识、意识形态、法律意识等基本学理与辩证、唯物史观的方法启迪,在有关法律意识形态的诸种观点基础之上,法律意识形态的概念界定并非空穴来风。

As an important academic concept, the legal ideology is very realistic, forward -looking, analytical and interpretative in the field of jurisprudence and sociology of law, and so it should not be ignored though often be overlooked. From the macro sense indirectly, legal ideology is a specific type of the ideology. From the micro sense directly, legal ideology exists in the structure of legal consciousness. Compared to the epistemology perspective, the sociological perspective is the breach of research on the legal ideology, which enables this concept to be one prospect academic concept. Based on the basic theories of consciousness, ideology and legal consciousness, and under the inspiration of dialectical and historical materialism method, the definition of the concept of legal ideology is not groundless.
