摘要
我国的土地权利体系中没有设定土地发展权。土地发展权的缺位导致农地保护成效差、土地征用中土地增值利益分配不公以及土地资源配置效率低下和土地规划难以执行。我国的土地发展权应当归属于土地所有权人。我国土地发展权的实现应当采取土地发展权移转和国家购买土地发展权相结合的方式,并结合国情实现土地发展权利益的公平分享。
The land development right(LDR) is a right for the landowner to change the use of land or to improve the use of land.There is no LDR in the system of land rights in China.The absence of LDR is not favorable to the protection of farming land,the fair distribution of land profits,the efficiency of land use,and the execution of the land plan.In China,the LDR should belong to the owner of land,and we should adopt a mode for the transferable development(TDR) and the purchased development(PDR) in accordance with our condition.
