论我国农村社区三元互动利益机制的建构

On Constructing the Interactive Mechanism of ternary-interest in Our Country's Rural Communities

现阶段我国农村社区建设在制度、市场、组织、文化等维度的利益非和谐现象日趋增多,严重制约着农村社区建设的进行,作为社会的综合现象,从根本上说是现行的制度安排扭曲了利益机制的作用。在法学理论上对利益基本原理进行解构,实现利益机制的反扭曲,建构双重利益模式和谐互促,利益聚合到利益和谐的转变和农民个体利益的实现等良性利益机制,是推进农村社区建设,构建和谐社会的新思路。

At present, inharmonious phenomena of interest in such dimensions as system, market, organization and culture of constructing communities in our country＇s rural areas are in a increase, which seriously restricts the construction of rural communities. As a social comprehensive phenomenon, it is basically the current institutional arrangement that has distorted the effect of interest mechanism. Deconstructing the basic principles of interest in legal theory, achieving the reverse - distortion of interest mechanism, constructing harmonious models of double profit from interest collection to interest harmony as well as the mechanism of realizing peasant＇s individual interest, are new thoughts of promoting the construction of rural communities and harmonious society.
