摘要
根据新闻侵权的归责原则、过错原则,新闻侵权具有四个构成要件。新闻侵权具有五种抗辩事由,即内容真实、权威新闻来源、受害人同意、公众人物受限、客观公正的评论及正当的舆论监督。新闻媒体如能恰当地运用这五种抗辩事由就能在新闻侵权官司中立于不败之地。
According to the imputation principle and the fault principle of news infringement, it has four constitutive elements and five plea instances. The five plea instances axe true contents, standard source of news, agreement of victim, restricted public character,impersonal and equitable review and intendance of public opinions. If news medias use the five plea instances felicitously, can they put themselves in an invincible position in the lawsuit of news infringement.
