用语严谨而规范,不仅是刑法典垂范久远的形式要求,更是刑法典价值和意蕴的体现。现行刑法中,诸如"或者其他"法律套语和弹性语言的使用有其积极的意义,但根据统计和分析相关数字及法条,刑法中"或者其他"的使用存在不必使用而使用、使用不慎重而滥用、使用不统一不规范的问题,这些要通过完善立法和规范司法、提高相关人员素质、平衡规则与自由裁量权之间的关系来解决。

Preciseness and standardization of diction is not only the formal requirement of criminal law but also the embodiment of the value and implication of penal code. In current criminal law, employing such legal verballsm and flexible language as＂ or something else＂ is of positive meaning, but will result in such problams as unnecessary, incautious and non - standard application judging from statistics and analysis of interrelated figures and legal rules ,which need to be resolved through improving legislation and standardizing justice, enhancing the quality of those concerned as well as balancing the relationship between rules and discretion.
