死缓制度中的期限问题浅析

A Discussion on the Period in the System of Death Sentence with Reprieve

死刑缓期执行制度是我国刑事立法的独创,有利于贯彻"少杀慎杀"的刑事政策,严格限制死刑的适用。但在死缓执行的过程中,死缓减为徒刑的期限、死缓犯执行死刑的期限及其相关期间的计算这三个方面存在问题,有待进一步探讨。

The execution system of death sentence with a reprieve is a unique creation of our country＇s criminal legislation, which is beneficial for implementing the criminal policy of＂ sentencing or executing death penalty less and carefully＂ and strictly limiting the application of death penalty. However,during the execution of death penalty with a reprieve,the issues of chaning the time limit of death penalty into prison sentence,time limit of executing death penalty as well as its period calculation are still to be further discussed.
