环境犯罪适用非刑罚措施探析

Non-Penalty Measures is Suitable to Environmental Crime

环境犯罪是指违反国家法律、法规,故意或过失实施的污染或破坏生态环境和生活环境,情节严重且触犯刑律的行为。环境犯罪具有主观恶性不深、人身危险性较小等特点,为非刑罚措施在环境犯罪中的适用创造了条件。在环境犯罪中适用非刑罚措施,使主观恶性不大的犯罪人用自己的劳动恢复被破坏的环境,从而达到提高环保意识的目的。

Environmental crime is a behaviour of pelluting and destroying environment intentionally or negligently with gravity of the eircumstances breaking the law.Because in environmental crime,the subjective evil is not strong and the personal dangerousness is minor,non-penalty measures can be suitablely applicated in the erime.Using the non-penalty measures,the ciminal who hasn＇t strong subjective evil can recover the destroyed environment through his own labour so as to reach the improvement of environmental protecting sense.
