关于建立校内教师申诉制度的若干思考

On establishing teacher's appeals system in Colleges and Universities

针对高校教师与学校之间的纠纷不断增加的现实,在分析校外教师申诉制度的缺陷以及校内工会维权制度缺失的基础上,提出建立校内教师申诉制度的紧迫性,并对校内教师申诉制度的实体和程序内容进行了设计。实体内容的设计包括校内教师申诉的主体、受理部门以及受理范围的界定等;程序内容的设计包括校内教师申诉的提出、受理及处理等相关制度的构建,并对相关责任作了探讨。

Based on the analysis of drawback of teacher appealing system outside school and lack of trade union＇s system on rights protection inside, as well as integrating with the reality of increasing disputes between teacher and authority of school, the paper claims the urgency of establishing teacher＇s appeals system inside colleges and universities and then makes out a general proposal for entity and process of the system. The entity includes the main part of appealing, executive authority and the framework of appealing and so on. The process contains the submission of teacher＇s appeal, in-processing period and the construction of relative regulations, as well as discussion of some relative responsibilities.
