An Overview of the Protection of the Basic Civil Right in China in Combination with Some Constitution-related Cases

文章结合涉宪案件对我国公民基本权利保障的现状、存在的问题进行分析,并提出完善的建议。通过对涉宪案件的分析研究,目的是要使宪法真正的有效实施,从而使公民能够依据宪法保障基本权利,限制国家权力。依法治国首先是依宪治国,只有宪法的制度设置完备了,才能推动其它法律制度的健全和完善,从而推动整个社会法治的快速发展。

The author focuses on analyzing the current condition and issues of the protection of the basic civil right in China in combination with some constitution-related cases and makes suggestions on improvement.The ultimate goal is to implement the constitution effectively so that the citizen can protect their rights and limit the power of the nation by constitution.We cannot govern a nation by constitution until we govern it by law.Only if we set up a complete constitutional institution,can we make the other laws and regulations perfect thus promoting the rapid social development and enabling the whole society to create a harmonious and legal society.
