立法的合理性评估

The Rationality Evaluation of Legislation

立法后评估是指法律实施一段时间以后,有关政府部门、组织或人员对其实施效果等进行评估,根据法律在实施中存在的问题,分析其立法上的原因,从而进一步完善立法。立法的"合理性评估"包括三个方面的评估:即法作为社会规范选择的合理性;立法权、立法程序、立法内容的合理性;法律绩效的合理性。

The legal performance evaluation is that some governmental sectors, organization and some people evaluate the legal performed effects , find the legislative problem in the enforcement of law and so to improve the legislation. The Rationality evaluation of the Legislation includes three aspects evaluation, the rationality of selecting the law as the social norm, the rationality of Legislative power, Legislative procedure and Legislative intents; the rationality of legal performance evaluation.
