我国行业协会信息公开制度探讨

Study on the Information Disclosure System of Chinese Trade Associations

商品经济发展和政府职能转变催生了我国的行业协会,并越来越成为我国社会经济发展的不可或缺的部分。与此同时,特殊的历史条件决定了现阶段我国的行业协会兼具政府性和营利性的特点,会对社会产生一定的负面影响,而立法的空白和外部监督机制的缺失又进一步放大了这种负面效应。为此,本文从行业协会对社会公共利益的影响的角度出发,系统分析了建立行业协会信息公开制度的必要性,并从信息公开的对象、信息公开的内容和范围、信息公开的方式这三个方面探讨了行业协会信息公开制度的基本构架。在此基础上,本文就如何建立并完善我国行业协会信息公开制度提出了几点建议。

The development of commodity economy and the transformation of government functions hastened the growth of Chinese trade associations and such growth is increasingly becoming an integral part of the development of Chinese socio-economy. At the same time, special historical conditions deicide the characteristics of Chinese trade associations in both government and profit, which really has got negative impacts on our society. Meanwhile, legislative gaps and lack of external oversight mechanisms further enlarge such negative effects. This study analyzes the necessity of establishing information disclosure system in Chinese trade associations from the perspective of their effects on public interest, studies the framework of such system from the users, the contents and scopes and the manners of information disclosure. On the basis of above study, the authors make several recommendations on how to establish and perfect the information disclosure system in Chinese trade associations.
