取得时效制度可以维护既存的社会秩序,解决纠纷;维护交易安全;促进物尽其用,充分发挥财产的利用效率;促进权利人及时行使权利;维护司法尊严,提高民事审判效率。取得时效制度的构成要件有:占有,善意占有,持续占有,占有的标的物需为他人之物,占有需经过一定期间。
The acquisitive prescription system can maintain the existing social order, settle disputes, retain transaction security, pro- mote the full use of things and give full free rein to property＇s efficiency of application, stimulate the right holder to carry out his or her rights in time, maintain judicial dignity and improve the efficiency of civil trial. The constitutional elements of acquisitive prescription system include：possession,possession in good faith,continuous possession, subject possessed being others＇and possession lasting a period of time.
