互补性创新模式下的许可合作均衡 被引量:4

Licensing collaboration equilibrium under the complementary innovation mode

摘要 在系统产业中,创新具有显著的互补外部性,合作和兼容是企业的占优策略行为选择。互补性专利许可会形成独特的纵向市场结构,"必要专利"基础上的机会主义行为会产生阻碍创新的"多重专利负担"和"反公共地悲剧"问题。交叉许可、专利池等许可合作组织形式有助于降低创新与许可中的交易成本,促进市场竞争和动态效率。因此,对互补性创新下的许可合作行为应该实行宽松的反垄断政策。 Complementary innovation is the main model in system industry, and cooperation and compatibility are the main behavior choice. Under complementary innovation, the IP institution will impede innovation because of tragedy of anticommons and multiple patents obligations. Crosslicensing and patent pools become the organization choice to realize innovation. Those organizations have the effects of improved innovation and competition. Thus the antimonopoly authority should take relaxed antimonopely policy.
