民营企业劳动者产权权益受损现象探析

An Inquiry into the Phenomenon of Private Enterprise's Violation of Laborer's Property Rights

改革开放以来,民营企业对我国经济和社会发展发挥了重要作用,但在民营企业内部,劳动者产权受损问题也较严重和突出。文章在分析民营企业劳动者产权权益受损现象的基础上,通过引入产权分析的方法,对这一现象产生的根源进行了分析。指出在信息不对称、存在交易成本的情况下,由于无法对劳动者产权进行充分界定,企业利用其强势地位,攫取大部分因劳动者产权界定不清而产生的置于公共领域里的价值,从而导致劳动者权益受损。

Since Reform and Opeping-up, private enterprises have played an important role in the economic and soeial development of our country. However, the phenomena of violating laborer＇s properly rights are more prevalent and serious in them. Based on the analysis of the phenomena of private enterprise＇s encroaching on laborer＇s property rights, this thesis explores the reasons of these phenomena bv the method of property right analysis and points out that private enterprises take advantage of their powerful status and seize most of the value in puhlic area due to ill-defined laborer＇s property rights raider fhe condition of asymmetry information and transaction cost. Therefore, laborer＇s fights and interests are damaged.
