摘要
从刑法及实践层面来看,我国对毒品犯罪无疑持严惩的态度,但毒品犯罪问题并没有在严刑峻法之下灰飞烟灭,反而有越演越烈之势。实践证明,"严打"并不能从根本上解决毒品犯罪问题,"宽严相济"的刑事政策在现阶段也许是一个正确的选择。
Looking from the criminal law and the practice stratification plane, our country hold the severe punishment manner without doubt to the drug crime, but the drug crime question has not solved under the draconian laws the smoke to extinguish, instead has gets stronger and stronger the potential. The practice proved that ＂striking hard＂ cannot fundamentally solve the drug crime problem, the criminal policy of combining punishment with leniency in the present stage is perhaps a correct choice.
