奥林匹克标志的知识产权保护

On the Protection of Olympic Symbol Intellectual Property

为了加强奥林匹克标志的知识产权保护,采用了文献资料法、专家访谈法、对比分析法、逻辑推理法分析了有关奥林匹克标志的基本法律问题,界定了奥林匹克标志的范围与性质。对我国奥林匹克标志的主要侵权形式以及奥林匹克标志保护的现状进行了概括和分析,找出了我国目前在法律适用和实施机构上存在的一些问题。提出了制定独立的《奥林匹克标志保护法》;开辟"奥运绿色通道";加大打击侵权力度;扩大宣传程度的对策。

To intensify the protection of the Olympic symbol intellectual property, the basic legal issues of the Olympic symbol are analyzed by means of documentary analysis, expert interviews, comparative analysis and deductive analysis ; and the scope and property of Olympic symbol are generalized. Then some current problems are pointed out in order to well set up the Olympic Symbol Protection Act and open up ＂Olympic Green Passage＂ and enhance fighting against infringement and expand advocacy degree.
