“自由裁量权”视角下足球裁判员的判决分析

Analysis on the Decision of the Referee Based on the Free Jurisdiction Perspective

运用文献资料调研、专家访谈和逻辑分析等方法,从法理学角度阐释了足球裁判自由裁量权的含义与特征。从规则的不完备性、裁判员的主观能动性和证据运用等三方面分析了足球裁判行使自由裁量权的影响因素。对近年来在世界足球大赛中有关裁判行使自由裁量权的个别案例进行实证分析。最后提出了采用足球裁判职业化、运用"自由心证"的经验法则与理性干预等手段控制裁判员行使自由裁量权的相关路径。

Through using the method of literature review, expert interview and logical analysis, this paper explains the meaning and characteristics of the judicial discretion on soccer referee from the view of the free jurisdiction, analyzes the influence factors of judicial discretion from the aspects of rule imperfection, referee＇s subjectivity and evidence application, discusses the individual case of it and put forwards how to regulate the exercise of the judicial discretion and preliminarily analyzes how to build a scientific and reasonable operational mechanisms.
