自然灾害防治中的环境法律问题

The Question of Environmental Law in the Natural Disaster Protection

频发的自然灾害对各个部门法都提出了诸多急需解决的法律问题,环境法自不例外。自然灾害法和环境法是两个相对独立的法律领域,但两者都涉及到特定社会关系的法律调整,这正是目前在自然灾害防治中所出现的、急需研究和解决的环境法律问题,具体包括:次生环境灾害的防治、紧急行政权力对原法律秩序的改变、不可抗力对法律责任的免除。解决前述问题,需对相关法律和《汶川地震灾后恢复重建条例》进行必要的修改完善。

The natural disaster bring a lot of legal questions to law department, such as the environmental law. Natural disaster law and environmental law are both independent law department, but there are some common legal questions, such as the protection and treatment of secondary disaster,the emergent administrative power and the act of God. In order to solve these questions, some law should be amended.
