目的通过案例的分析,积极探索适应经济发展需要的职业卫生监管的新思路。方法对职业卫生行政处罚案例的执法主体、处罚额度进行分析讨论。结果卫生行政部门要明确职业卫生职能调整后的执法主体,可结合实际予以减轻处罚。结论建议通过及时修订职业卫生法律,加强部门协作沟通,加大职业卫生法律等知识宣传以及坚持处罚与教育相结合原则等措施,全面促进职业卫生防治工作的深入开展。

[ Objective ] To explore fresh ideas for the occupational health supervision that adapts to the economic development through the case analysis. [ Methods] Analysis and discussion were made on the law executive subjects and punishment amount in the case of occupational health administrative punishment. [ Results] The health administrative department should nail down the law executive subjects after the adjustment of occupational health function and lighten the punishment according to the facts. [ Conclusion ] It is suggested to improve the occupational health prevention work through the emending occupational health law, strengthening coordination between departments, enhancing occupational health education and combining punishment and education.
