经济法的法律部门性质及社会功能一直被持续性加以讨论,但是如果放宽视野,从经济体制改革所引起的中国社会深层次结构的变迁来看,经济法实际上深刻因应着中国三十年改革背景下如何妥善协调多元化的社会阶层分化主体的各自利益诉求,如何对改革中形成的失衡利益格局加以公平再分配。经济法需要秉持法律的基本品格即保障个人权利,但同时需要承负起社会公平调节的职责。从经济的国家调节到利益的社会再分配,正是漆多俊先生的一条曲折而清晰的思想路线。

The nature of the legal departments and social function of economic law has been continuing to be discussed. But if we relax the vision, from the deep-seated society structural caused by the economic reform of China, we can conclude that the economic law actually is the law which is in response to the main of their respective interests＇ demands of a wide range of social class and to change the interest distribution from imbalance to fairness. Economic law not only need to uphold the basic character of the law and which protects individual rights, but also need assume the duties for social equity adjustments.
