法律的合法性从何而来是法哲学中的一个热门话题。这一话题和道德与法律关系问题存在着内在的逻辑关联。文章侧重从道德与法律的关系维度入手,探究哈特对法律合法性之源问题的解决路向,审视哈特规则模式所招致的批判,并试图通过探讨哈特理论模式之优势与缺失,从而深化对"合法律性的合法性"何以可能的理解。

The source from whence the law draws its legitimacy is a hot topic in legal philosophy. There exists inherent logic between this topic and the related issues involving morality and law. Focusing on the relationship between morality and law, the thesis explores Hart＇ s solution to the origin of the law＇ s legitimacy, probes into the criticisms on Hart＇ s theory, and by way of inquiring into the advantages and defects of Hart＇ s theory, tries to deepen the understanding of the question ＂how the legitimacy of legality can be possible＂.
