摘要
我国《劳动合同法》的损害赔偿规则体系应由限额赔偿、加额赔偿和等额赔偿三种制度有机结合而成。限额赔偿是法律对处于双重赔偿主体情形下之劳动者采取的特别保护措施。加额赔偿是严重侵害劳动者权益的用人单位应当承担的惩罚性赔偿责任。除此之外,劳动合同的双方主体在因自己行为致对方损害时,均应依法承担等额赔偿责任。三种制度相辅相成、浑然一体、并行不悖,共同体现与满足劳动关系法律调整的本质需求。
The compensation system of the labor Contract Law of the PRC should be the organic combination of the three rules of closed compensation, excess compensation and equal compensation. Closed compensation is a special protection for the laborer faced with double compensation subjects. Excess compensation is a punitive compensation and should be born by the employing unit who has severely infringed on the rights and interests of the laborer. Besides, either of the two parties to the labor contract shall boar the liability of equal compensation pursuant to the relevant law when either of the parties has brought damages to the other party due to its own acts. the three compensation rules complement one another as an organic whole with no contradictions, and they combine to embody and satisfy the essential requirements of the legal regulation on the labor relation.
