摘要
合同是保障体育赞助行为成立有效的基础性法律文件。在体育赛事商业开发中,由于体育赛事参与主体的多元性与赛事资源的有限性,体育赛事举办主体签订的赞助合同与体育赛事其他参与主体已经签订的赞助合同可能产生冲突,从而影响整个赛事商业运营的效果。本文分析了体育赛事赞助合同与在先赞助合同冲突的类型、原因,并提出了预防措施,为赞助双方签订合同提供有益的法律参考建议。
Contract is the foundational legal document to guarantee the establishment and validity of sports sponsorship. In the business exploration of sport events, because of the multi-dimensionality of sports events and the limit of resources, the support contract signed by the holder of sports events and sponsorship contract signed by other participators may conflict with each other which would probably do harm to the business benefit of sport events. "Finis paper analyzes the style and causation of the conflicts mentioned above and poses certain prevention measures in order to provide legal suggestions to the participants of the sport sponsorship contract.
