论大学生权利在教育行政机关的救济

On the Relief of College Students’ Rights in Education Administration Organization

教育行政机关救济机制在解决大学生与高等学校法律争议方面,具有高度专业性、成本低廉、利于行政机关对高校的监督和纠错、尊重大学自主权的优势。不过也必须认识到教育行政机关救济机制自身仍存在若干缺陷,亟待完善。文章通过比较分析后,认为应该进一步完善我国教育行政机关救济机制,从而充分发挥教育行政机关救济的作用,以有效地解决高校与学生的纠纷,并实现对学生权利的救济。

On solving the law controversies over college students and universities, education administration organization relief system has its own advantage. Such as they are professional, and with low cost, easy for administration to monitor and correct universities, and respect college students＇ advantages. But the system also has several disadvantages needs to be improved. After a comparative analysis, we believe that the system needs to be perfected to give full play to its relief function, and so that to solve the controversies over universities and students effectively and realize the relief of students＇ fights.
