Legal Consideration on Sport Lottery from the Case of Xi'an BMW

从"西安宝马案"入手,运用文献资料法,分析相关法律法规尚不完善,体育彩票的发行、销售、监督等方面出现的问题,进而提出制定《彩票法》及实施细则;建立国家彩票监督委员会及省级彩票监管办公室;实施彩票体制改革;建立体育彩票的从业人员资格证书制度;代销单位的资质必须经过国家彩票监督委员会的严格审查;省级彩票监管办公室必须与体彩中心和公证处三位一体,共同监管等对策。为了体育彩票市场的健康发展提供理论参考。

From the case of Xi＇ an BMW and using the method of literature, this paper found out that correlative laws and regulations were imperfect, the issue of distribution, sale and monitoring on sport lottery have raised. It proposed that the formulation of lottery law and implementation manual should be setup, the nation lottery monitoring commission and office should be established, the system reform of sport lottery should be carried out, the qualification certification of practical personnel should be built up. The main purpose is to provide the theoretical reference and healthy development in sport lottery market.
